An Ordinance Approving and Authorizing the Extension of the Boundaries of the City of Gillette, Wyoming, and Annexation of a Tract of Land Known as the Antelope Valley and Crestview Estates Addition Annexation, Contiguous and Adjoining the Present Boundaries of the City of Gillette, and Establishing A C-1, General Commercial Zoning District, a C-P, Planned Neighborhood Business Zoning District, an R-1, Single Family Residential Zoning District, an R-2, Single and Two Family Residential Zoning District, an R-4, Multi-Family Residential Zoning District, an R-R, Rural Residential Zoning District, I-1, Light Industrial Zoning District, and an A, Agricultural Zoning District Subject to all Planning Requirements.

The City of Gillette has received prior non-contiguous annexation agreements and annexation petitions executed by landowners within the Antelope Valley and Crestview Estates Addition Annexation area.  The proposed annexation consists of 742.48 acres and is immediately adjacent to the current City corporate boundary.

 

The Certification of Determination of Substantial Compliance of the Annexation Petition has been signed by the City Clerk as required by State Statutes. The certification indicates that the Annexation Petition substantially complies with Wyoming Statutes 15-1-401 through 15-1-423.

A majority of the landowners owning a majority of the area sought to be annexed have petitioned the City to annex 742.48 acres into the City limits. The land is located generally west of South Douglas Highway, south of the existing City of Gillette corporate limits. The property is contiguous to the current City boundaries to the north. The annexation area has mostly residential uses, some commercial uses, and a few industrial uses, as well as agricultural land. The owners desire to have the tract annexed and zoned for residential, commercial, and industrial uses with access to City services.

Any future development or construction will be reviewed by the City and shall meet City standards.

There is no significant City investment required in support of this annexation for water, sewer, streets, drainage or parks. The City had budgeted $34,500 for the development of the annexation plat and certified notices. This area is a logical extension of the City limits and will be serviceable.  The proposed zoning of the area is C-P, Planned Neighborhood Business District, A, Agricultural District, C-1, General Commercial District, I-1, Light Industrial District, R-1, Single Family Residential, R-2 Single & Two Family Residential, R-4, Multiple-Family Residential and R-R, Rural Residential. The proposed zoning meets the intent of the Comprehensive Plan. The existing development pattern is compatible with the proposed zoning. The City Council will make the final zoning determination at the time of annexation.

 

Water, Sewer and Electrical services are available for the annexation area and the annexation area is currently served by various districts, including current City of Gillette utility services.

  

Upon annexation, the majority of the existing street network will be owned and maintained by the City of Gillette. The street network will receive routine maintenance, as would be typical with any City street.  The existing parks within the proposed annexation boundary will continue to be maintained by the Campbell County Parks and Recreation Department.

Further, upon annexation all residents and businesses will receive all standard and customary services provided to current City of Gillette residents.  These services include standard police services and animal control activity, code enforcement, street sweeping and snow removal, as well as solid waste collection.

Landowners within the Antelope Valley and Crestview Estates Addition annexation boundary will be represented by Ward 2 City Council Members.  Currently, Councilman Billy Montgomery and Councilman Tim Carsrud represent Ward 2 on the City Council.

The only additional tax upon landowners resulting from annexation is an additional 8 mills ($8.00 per $1,000 of assessed value) collected by the City for general operation of the City. The County Tax Assessor’s Office is responsible for establishing the classification of property, assessed value and the assessment rate. 

As per the State of Wyoming Statute 15-1-405, each landowner was provided a letter by certified mail, including the Public Hearing Notice, outlining specific items such as water and sewer services, electrical services, as well as a more comprehensive outline of the items previously mentioned.
