Council Consideration of a Professional Services Agreement for Construction Management Services Associated with the Interstate Industrial Park L.I.D. and Street Improvements Project, with DOWL, in the Amount of $505,262.00 (1% Project).
BACKGROUND:

The Interstate Industrial Park Water District had initially hired DOWL to evaluate their aging water system and to develop options for upgrading the system, including considerations for long term operations and maintenance. After various options were presented to the Board and several members of the Water District, they decided to approach the City to pursue the formation of a Local Improvement District (L.I.D.) for replacement of their entire system. The creation of the L.I.D., Special Improvement District No. 52, was subsequently accomplished through City Ordinance No. 3937 in November, 2017. 

The final design and bid schedule included two schedules of work: water system improvements and street improvements. The water system improvements will consist of the abandonment of the existing water well and facilities; installation of approximately 7,200 lineal feet of 12” PVC and 450 lineal feet of 6” PVC water mains; connections to the City’s existing water system in four separate locations; the installation of approximately 2,500 lineal feet of 4” water service line, with approximately 1,100 feet being installed by horizontal directional drilling; near the property line, the new 4” service lines will be reduced to a 1” service line and connected to the existing services; installation of 44 meter pits, one for each service line; the installation of 17 fire hydrants; and all necessary appurtenances.  All water system expenses will be assessed to the property owners within the L.I.D. after final completion of the project.

The City of Gillette will reconstruct 2nd Street and Conestoga Drive outside the costs of the water system improvements.  These expenses will not be included in the assessment for the L.I.D. The construction of these improvements will be a 1% Project. The street improvements will consist of the reconstruction of approximately 5,950 lineal feet of pavement within 2nd Street and Conestoga Drive. These streets were considered for a Pavement Management System project in the past. However, staff delayed these improvements until the water system improvements could be installed in conjunction.

DOWL has performed the design and bidding services for the Interstate Industrial Park L.I.D. and Street Improvements Project.

Construction Management (CM) services for the 190 working day contract will include the standard services relating to Engineering, Inspection, Record Keeping, Surveying, and Materials Testing.

The cost breakdown for the CM fee is as follows:

The CM Fee is broken into two categories: Water Improvements and Street Improvements. The CM fee for the water improvements will be paid initially through 1% Optional Sales Tax funds, reimbursed by the secured State Loans and Investments Board (SLIB) Drinking Water State Revolving Fund (DWSRF) Loan and, ultimately, through the assessment of the properties within the L.I.D. The CM fee for the street improvements will be paid by 1% Optional Sales Tax funds.

The proposed fee equates to $2,659.27 per day of construction, or 13.5% of the construction bid amount.

ACTUAL COST VS. BUDGET:

The initial funding for the water system Construction Management (CM) of this project has been allocated from the 1% Optional Sales Tax Account 201-10-05-419-40-47440, L.I.D. Improvements Fund, to be reimbursed by the secured State Loans and Investment Board (SLIB) Drinking Water State Revolving Fund (DWSRF) Loan and, ultimately, through the assessment of the property owners within the the L.I.D.

The City has also allocated funding from the 1% Optional Sales Tax Account 201-10-05-419-40-44331 for the CM of the reconstruction of Conestoga Drive and 2nd Street.
