The City of Gillette and the South Douglas Highway Water and Sewer District entered into a Sewer Utility Service Agreement in June of 2003, to provide City sanitary sewer service to the District via the City's South Douglas Highway Sanitary Sewer trunk line and collector lines. The Sewer Utility Service Agreement ultimately contained four (4) amendments, the last of which was executed in April of 2007.
Amendment No. 4 to the Sewer Utility Service Agreement contained provisions that the City would assume ownership of the portions of the system that have become annexed, have no liens against the improvements, and have been requested for conveyance to the City by the District.
Upon request of the District to convey a portion of their sewer system, City staff, along with the South Douglas Highway Water and Sewer District, have prepared an Agreement to Convey Sewer System to convey portions of their sanitary sewer system to the City of Gillette which are contained within the recently annexed Antelope Valley and Antelope Valley Phase II Subdivisions. The portions of the sewer system proposed for conveyance are identified in Exhibit A, as attached. The City has performed all routine operations and maintenance of the Antelope Valley Sewer System since it was complete in the mid 2000's. When a blockage or deficiency is observed, the District has been responsible for making repairs to the system. To-date, the system is in good working order with no know deficiencies at this time. The City will be accepting the identified portions of the system "as is, where is".
The District will also convey any existing easements to the City of Gillette for those portions of the system which are not contained within City Right-of-Ways. The identified portions of the system to be conveyed have not been pledged as collateral for the repayment of debt associated with the improvements.
The Agreement to Convey Sewer System was approved by the South Douglas Highway Water and Sewer District on March 28, 2018, and is attached for reference. |
