Council Consideration of a Bid Award for the 4J Pathway Repairs Project to Wyoming Earthmoving Corporation (WEC), in the Amount of $150,014.60 (1% Project).
BACKGROUND:
This project consists of re-grading and installing 840 SY of Asphaltic Pavement on the 4J Pathway in the area between Campbell County Public Heath South Parking Lot Entrance South to W. Walnut Street (see attached map).
ACTUAL COST VS. BUDGET:

The City of Gillette, Purchasing Division, opened bids for this project at the City Warehouse on Tuesday, June 5, 2018 at 2:30 P.M.

The following table summarizes the bids received and the Engineer's Estimate.

BID IRREGULARITIES

The two bidders on the project were Wyoming Earthmoving Corporation (WEC), and Simon Contractors.  Both bids were submitted on time and had the required Bid Bond.  Both bids included a Residency Certificate.

Wyoming Earthmoving Corporation (WEC) was the low bidder but the bid spreadsheet provided to WEC by the Project Engineer had an error in the formula.  The total bid amount only showed the bid total of the first page and excluded the 8 bid items on the second bid page.  The WEC bid form submitted had a total Base Bid of $113,561.40 and an Alternate Bid of $120,961.80.

The WEC submitted bid was correct in all individual bid item unit prices and bid item total prices.  The corrected total bids including the 8 bid items on the second page are listed in the above table.  The bid irregularity caused by the error on the supplied electronic bid spread sheet was not the fault of WEC and is considered informal by the contract bidding documents.  The WEC bid is mathematically correct and when the 8 bid items price list on the second page are included, was the lowest qualified bid for the project.

The low bidder, WEC, has met the necessary requirements for bidding and we recommend that the City of Gillette award the Base Bid for the project to WEC at the bid amount of $150,014.60.

CONSTRUCTION ESTIMATE

The low Base Bid is 12.8% above the Engineer's estimate and 6.5% below the average of the bids submitted.  The low Alternate Bid is 11.3% above the Engineer's estimate and 5.8% below the average of the bids submitted.

BUDGET

Monies for this project have been budgeted from the current FY-17/18 1% Optional Sales Tax Fund #201-10-05-419-40-44332 in the amount of $105,000, with the remaining $50,000 plus coming from FY-18/19 1% Optional Sales Tax Fund #201-10-05-419-40-44332 account which will have, if approved, $125,000.00.

CONTRACTOR'S REVIEW

WEC has no apparent problems with their bid.  WEC is a local contractor based in Rozet.  They have 25 employees and bring in additional summer help.  Mike Walter who is their project manager has approximately 20 years experience with DRM prior to moving to WEC and has worked on numerous City projects.  Mike stated that WEC is currently on the City Contractor list for emergency repairs and just completed several small projects for the City over the past month.  Their existing personnel is familiar with the City of Gillette construction requirements and procedures.  WEC has the necessary equipment to complete the project and a number of experienced people on their staff.

WEC is using qualified subcontractors for the asphalt, concrete and landscaping portions of the contract.
