City Staff recommends the City Council "not approve" the Ordinance on 2nd Reading, and recommends the City Council send this case "back" to the City Planning Commission for further review and study. This is a change from prior recommendations. Please see attached Staff Memo for revised recommendations. (Ordinance 2nd Reading - June 19, 2018)
The owner is proposing to rezone 1.08 acres of land from R-2 Single and Two Family Residential District to C-2, Central Business District. The owner, in looking at traffic coming off of 4-J Road and traveling down West 4th Street, feels that a zone change from R-2 to C-2 would better suit the properties as this is a heavy traffic route to Gillette Avenue, and the abutting zoning leading to Gillette Avenue is already zoned C-2. Furthermore, the owner’s business that he wishes to locate at said property is a law firm, which he feels would benefit from being in close proximity to the downtown area while still maintaining some privacy for clients by being off-set from Gillette Avenue.
The property was originally platted with the City of Gillette on March 2, 1914, Book 1, Page 4. The proposed area is bounded on the south, west, and north by R-2 Single and Two Family Residential, C-2 Central Business to the east, and R-4 Multi-Family Residential to the southeast. As per the zoning regulations there is no minimum zone lot size for C-2; the minimum district size is 20 acres which it would meet as it would extend into the already existing C-2 district that is currently at 319.773 acres.
Pursuant to Section 12 of the City of Gillette’s Zoning Ordinance, a Zoning Map Amendment shall not be approved except to:
(1) Correct an obvious error, or
(2) Recognize changing conditions in the City
The proposal to rezone 1.08 acres of land from R-2 Single and Two Family Residential District to C-2, Central Business District recognizes the changing conditions in the city with respect to the expanding commercial and office nature of the downtown area.
The Planning Commission considered this case at their May 8th, 2018 meeting. The case passed on a 5-0 vote. |
