Legends Lounge was annexed into the city in December 2017. At the time of annexation, the existing drive-up window was not being utilized. Recently, Legends has requested a drive-up window for the sale of alcoholic and malt beverages, and utilizing the existing opening on the north side of the building.
Before staff would consider placing this item on an agenda, a couple requirements needed to take place. First, bollards around the electrical infrastructure located near the proposed drive up lane needed to be positioned around the electrical infrastructure. Although the electrical infrastructure is currently being maintained by Powder River Energy, the City of Gillette will take possession of it in a few years. Therefore, staff required that a future City asset be protected and required that the bollards be placed around the electrical infrastructure. Secondly, Legends had established a fence surrounding an unapproved extended serving area that also enclosed the driveway of the proposed drive up window area. Staff informed Legends that they were in violation of State Statute and City Code and the fence enclosing the driveway and the proposed drive up window area, needed to be removed.
Legends hired a contractor to construct the driveway and install the bollards. After the contractor had finished the work, Engineering was contacted to inspect the area to ensure all the work met the City's requirements. Engineer Schoen inspected the drive-up lane and ensured the bollards were positioned around the electrical infrastructure as required and met City standards.
