Council Consideration of a Resolution Approving and Authorizing the Final Plat Known as the Steele Subdivision, a Resubdivision of Lot 1, Foothills Theatre Addition and Lot 2, Renew Subdivision, to the City of Gillette, Wyoming, Subject to all Planning Requirements.
BACKGROUND:

The owner, Steele and Steele Property LLC, is proposing to subdivide 3.82 Acres of land located at 650 N Hwy 14-16 and 623 Commercial Drive for the purposes of ownership and to facilitate future development.  The subdivision includes the existing Lot 1 of the Foothills Theatre Addition and Lot 2 of the Renew Subdivision.  This subdivision will create two (2) lots. Lot 1 (3.382 acres) and Lot 2 (.435 acres).

A 25-foot private ingress and egress easement was established in 1992 when the original RENEW Subdivision was created from the Gillette Business Park Addition and the Tarver Ranch Company Addition. Staff has reviewed the 1992 case file and have determined the existing 25-foot private ingress and egress easement is unnecessary for the utilization of the properties. Properties located on Commercial Drive which currently have access through the easement have adequate access on Commercial Drive.  As the owner intends to expand the theater to the south, the existing easement is required to be vacated. This plat, by virtue of the subdivision regulations, vacates the easement as necessary.  Also, an access and exit easement is to be vacated with this plat.

Lot 1 will continue to have access from Highway 14-16 through a 60-foot access and general utility easement as well as the remaining portion of the 25-foot private ingress and egress easement located on lot 2, Foothills Theater Addition.  Lot 2 of the proposed subdivision will continue to have access from Commercial Drive.

All other existing utilities have been provided with property utility easements for access.

Any future site development will be required to undergo a commercial site plan review. Planning Commission passed this case on a 7-0 vote.
