Council Consideration of a Request from Absolute, LLC, d.b.a. Legends Lounge, Located at 10800 S. Hwy 59, Ste. 100,  to Extend Their Serving Area to Include a 5,393 Square Foot Area on the East Side of the Building.
BACKGROUND:

Recently, it was discovered that Legends was utilizing an area on the north and east side of the building as an area for their patrons to consume and be served alcoholic and malt beverages, Legends was informed that they were in violation of State Statute and City Code by using this area as it was an unapproved extended serving area. In January of 2018, a small extended serving area was approved to allow Legends' patrons to utilize a smoking hut on the east of the building. Sometime last spring, Legends built a buckboard fence and began allowing their patrons to consume and be served alcoholic and malt beverages in an area on the north and east side of their building without approval of the City Council. Staff informed Legends of the violation and that they were to cease any and all consumption and serving of alcoholic and malt beverages in this area until approval by City Council was sought.

 

As a response to the violations, Legends sought, and was approved a drive thru area. However, before staff would place this request on an agenda, Legends had to take care of the electrical infrastructure by placing bollards around the infrastructure and remove the fencing from around the unapproved area they were using for serving and consumption of alcoholic and malt beverages. Those requirements were fulfilled and on November 20, 2018, a drive thru window was approved by Council.

 

This request is to extended a serving area on the east side of the building. The area will be fenced with buckboard type fencing and the requested square foot area is 5,393 sq. ft. The area will include a horse shoe pit and corn hole boards.
