Zoning Map Amendment – Copper Ridge Estates, Phase II

CASE SUMMARY:

The owner is proposing to rezone 15.62 acres of land located west of Copper Ridge Estates, Phase I. 

CASE BACKGROUND:

The owner is proposing to rezone 15.62 acres of land from R-S, Suburban Residential District to R-1, Single Family Residential District.   The purpose of the rezoning request is to accommodate the proposed Copper Ridge Estates, Phase II Subdivision lot areas and widths.  Not all of the proposed lots meet the minimum size requirements or lot width requirements to keep the zoning at R-S, Suburban Residential.

The average lot size in the proposed subdivision is 19,754 s.f.  The minimum lot size in the R-S, Suburban Residential District is 22,000 square feet.  While the smallest proposed lot is approximately 14,375 square feet, all of the lots in the proposed subdivision must meet the minimum size requirements.  The minimum lot size in the R-1, Single Family Residential District is 6,000 square feet, which all proposed lots meet this requirement.

The required setback distances in an R-1 District are different than those in the R-S District.  In the R-1 District the Front Yard Setback is 20’, the Side Yard Setback is 5’, and the Rear Yard Setback is 20’ or 20% of the depth of the zone lot, whichever is smaller.  The Minimum Width of the zone lot is 50’ at the front setback line.

In the R-S District the Front Yard Setback is 40’, the Side Yard Setback is 15’, and the Rear Yard Setback is 40’.

Also, the Minimum Width of the zone lot is 125 at the front setback line.

The surrounding zoning is:

North – R-S, Suburban Residential District

East – R-1, Single Family Residential District

South R-R, Rural Residential District

West – R-S, Suburban Residential District

The minimum District Size for an R-1, Single Family Residential zone district is 10 acres. The area of the proposed rezone being 15.62 acres meets the minimum district requirement.  The proposed rezone will match the adjoining R-1, Single Family Residential District to the south east to further increase the zone district area

This zoning request is in accordance with the current Comprehensive Plan.

Pursuant to Section 12 of the City of Gillette’s Zoning Ordinance, a Zoning Map Amendment shall not be approved except to:

(1)   Correct an obvious error, or

(2)   Recognize changing conditions in the City

The proposal to rezone 15.62 acres of land from R-S, Suburban Residential District to R-1, Single Family District, recognizes the changing conditions in the City.
