Council Consideration of a Bid Award for the Pavement Management System 2019 Project to Simon Contractors, in the Amount of $2,949,480.25 (1% Project).
BACKGROUND:

The Pavement Management System 2019 Project will include three schedules of work.  Schedule A is the reconstruction of four (4) blocks of 5th Street between Emerson Avenue and Highway 59.  Schedule B includes the reconstruction of approximately 1250 lineal feet of Gurley Avenue from Kluver Road north to the corporate limits.  Schedule C includes the reconstruction and widening of approximately 5000 lineal feet of Kluver Road from Boysencreek Drive to Garner Lake Road.

Schedule A - 5th Street is an asphalt street that will be reconstructed in asphalt, with miscellaneous curb, gutter, and sidewalk repairs.

Schedule B - Gurley Avenue is currently an asphalt street overlying cement treated subgrade.  Approximately 400 feet of street has curb and gutter, the north 800 feet of road is a rural section with no curb and gutter and has a borrow pit drainage.  The initial design of the street was to reconstruct the road in concrete with the addition of storm sewer and curb and gutter to manage runoff.  Due to the initial cost estimates, the curb and gutter with storm sewer was made an Additive Alternate Bid Item to be awarded if available funds allowed after the base bids are totaled. During the pre-bid meeting, contractors requested alternative pavement sections.  By Addendum, an asphalt alternative section was added to the bid package.

Schedule C - Kluver Road is an existing asphalt road that is three lanes from Boysencreek Drive to Ash Meadows Drive.  From Ash Meadows Drive to Garner Lake Road,  Kluver Road narrows to two lanes without an emergency shoulder.  The road from Boysencreek Drive to Ash Meadows Drive will be reconstructed with the existing geometry. East of Ash Meadows Drive, the grade of Kluver Road will be lowered and widened to provide emergency runoff shoulders and shallower ditch slopes.  Design was conducted in close coordination with Rocky Mountain Power who owns the power line north of Kluver Road and Powder River Energy who owns the power line south of Kluver Road.  The initial design was for an asphalt road surface.  During the pre-bid, contractors requested an alternative bid for concrete surfacing.  The alternative for the concrete section was added by addendum.

Fifth Street will be allowed 45 working days to substantial completion and must start no later than July 15, 2019.  Gurley Avenue is allowed 45 working days to substantial completion and must start no later than September 1, 2019 and cannot be closed until Kluver Road is open for traffic. Kluver Road work is allowed 95 days to substantial completion and must start no later than May 1, 2019.  The constraints on the schedules were included to help minimize the impact the work will have on school bus routes.

Bid Opening

The bid was structured with eight (8) separate bid schedules. The contractor was required to provide a bid for each schedule.  The summary of the bid tabulations are attached as an exhibit of this agenda item. The results of the summation of the lowest base bid plus the lowest cost pavement option are tabulated below.

Upon review, it was determined that Croell's bid was considered non-responsive because they did not include unit prices or total for all the alternates as required by Addendum 2 to be considered responsive. Croell's bid, when considering the alternates they did provide, would not have been low bidder.

Simon Contractors has indicated they are comfortable with their bid and that they have the equipment, materials, and manpower to complete the project in the time allowed.

ACTUAL COST VS. BUDGET:
The lowest bid was from Simon Contractors in the amount of $2,811,267.75.  Adequate budget is available to also award the additive alternate in the amount of $138,212.50.  The total recommended contract for PMS 2019 will be ($2,811,267.75 + $138,212.50)  $2,949,480.25. 
SUGGESTED MOTION:
I move Approval of a Bid Award for the PMS 2019 Project to Simon Contractors, in the Amount of $2,949,480.25 (1% Project).
